Terms of Service

1. Acceptance of Terms
By accessing or using the Agentic AI FAQ Bot Platform ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including Starter plan subscribers, Agency plan subscribers, and any end-users who interact with chatbots deployed through the Platform.
2. Description of Service
The Platform provides software-as-a-service (SaaS) tools that enable businesses and agencies to deploy AI-powered FAQ chatbots on their websites. The Platform grants subscribers access rights to hosted software infrastructure only — no software ownership or download rights are conveyed. Features include chatbot widget embedding, FAQ management, analytics, and multi-business management for Agency subscribers.
3. Subscription Plans and Payment
The Platform offers subscription plans billed on a recurring monthly basis. Current pricing is available on the pricing page. Subscriptions are processed through Stripe, a third-party payment processor. By subscribing, you authorise recurring charges to your payment method. Subscriptions auto-renew unless cancelled before the renewal date. Cancellations take effect at the end of the current billing period; no partial refunds are issued for unused time.
A five-day grace period applies to failed payments. If payment is not received within the grace period, access to the Platform will be suspended. Reactivation is available at any time by resuming your subscription.
4. Agency Subscribers — Payment Processing Disclaimer
Agency plan subscribers ("Agency Owners") may use the Platform to provide chatbot services to their own clients ("End Clients"). The Platform has no involvement in, and accepts no liability for, any payment processing arrangements between Agency Owners and their End Clients.
Agency Owners are solely responsible for:
- Setting up and operating their own independent payment processor (e.g., Stripe, Square, PayPal).
- Complying with all applicable laws and regulations governing their payment collection activities.
- All chargebacks, refunds, disputes, and financial liability arising from their transactions with End Clients.
- Ensuring their pricing, invoicing, and billing practices comply with consumer protection laws in their jurisdiction.
- Obtaining any necessary licences or registrations required to collect payments in their jurisdiction.
The Platform is not a party to any agreements between Agency Owners and their End Clients. Agency Owners are the merchant of record for all transactions with their End Clients.
5. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law or regulation.
- Transmit spam, malware, or other harmful content through chatbot interactions.
- Impersonate any person or entity or misrepresent your affiliation.
- Attempt to gain unauthorised access to the Platform or other users' accounts.
- Use the Platform to collect sensitive personal data (e.g., payment card numbers, passwords) through chatbot conversations.
- Resell or sublicense access to the Platform without our express written consent.
6. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of the Platform and any data you process through it complies with applicable data protection laws, including GDPR and CCPA where applicable.
7. Intellectual Property
The Platform and its underlying technology, design, and content are owned by Agentic AI and protected by intellectual property laws. You retain ownership of the FAQ content and business data you upload to the Platform. By uploading content, you grant us a limited licence to process and display that content solely for the purpose of providing the Service to you.
8. Disclaimers and Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate or complete.
To the maximum extent permitted by law, Agentic AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your subscription at any time through your portal. Upon termination, your right to access the Platform ceases immediately; your data may be retained for a limited period before deletion.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Agentic AI operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
